  1. Scope of application

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by the company Maison Aïla operating under the brand name Maison Aïla ("the Seller") to consumers and non-professional buyers ("the Customers or the Customer"), wishing to acquire the products offered for sale by the Seller ("the Products") on the website: https://maisonaïla.com/ .

These General Conditions are presented in French. They will also be translated into English, but in the event of disagreement or discrepancy, the French version shall prevail.

These General Terms and Conditions of Sale specify the conditions for ordering, payment, delivery and management of any returns of Products ordered by Customers. These General Terms and Conditions of Sale may be supplemented by specific conditions, presented on the Site, before any transaction with the Customer.

They are accessible at any time on the website https://maisonaïla.com/.com/ and will prevail, where applicable, over any other version or any other contradictory document.

Maison Aïla may update these T&Cs at any time. The version applicable to the Customer's purchase is the one in effect on the website on the date the Order is placed.

Any order for a Product offered on this Site implies the purchasing Customer's acceptance of these General Conditions of Sale.

  1. Products offered for sale

The Products offered for sale by Maison Aïla are those described on the Site on the day of consultation by the Customer, within the limit of available stocks.

The error in updating the available stock does not engage the responsibility of the seller who cannot, consequently, be held responsible for the cancellation of an Order for a Product due to the exhaustion of stock.

In the event that a Product is unavailable after an order has been placed, Maison Aïla will inform the Customer by email as soon as possible.

The main characteristics of the Products and in particular the specifications, photographs and indications of dimensions of the Products, are presented on the website: https://maisonaïla.com / . If every effort is made to ensure that the color of the Products displayed on the Site are faithful to the original products, variations may occur. Maison Aïla cannot be held responsible for errors or inaccuracies in the photographs of the products appearing on the Site.

The Customer acknowledges having the required capacity to contract and acquire the Products offered on the website: https://maisonaïla.com/ . The choice and purchase of a Product is the sole responsibility of the Customer.

It is expressly stated that the “Maison Aïla” Products are exclusively reserved for direct sale to consumers who are natural persons or non-professional legal entities, known as end consumers. The Customer undertakes to act as an end consumer and is prohibited from acquiring the products with a view to reselling them as part of a commercial activity.

  1. Orders

Placing an order : Any order placed on the Site constitutes express acceptance of the General Terms and Conditions and constitutes acceptance of the prices and Products available for sale on the Site.

Order process : Placing an Order on the Site is subject to compliance with the procedure set up by Maison Aïla comprising successive stages leading to validation of the Order.

  1. Product Selection : The Customer may select one or more Products in the number they wish and this selection will be automatically added to the Basket (“the Basket”).
  2. Content verification : By clicking on the Cart, the Customer will be able to view the list of Products he has chosen. As long as the Order is not validated, the Customer will always have the possibility to return to the Cart and modify it if necessary.
  3. Identification : The Customer must create an account by completing the identification form provided and providing the requested information. The Customer undertakes to complete this information accurately. The Customer who already has a customer account must identify himself by entering his username and the password that he provided when creating his account.
  4. Verification of the Order : It is the Customer's responsibility to verify the accuracy of the Order, the total price, the personal information and to immediately report or rectify any errors before its final validation.
  5. Validation of the Order : The Customer validates his/her delivery and payment method. The Customer must confirm his/her acceptance of these General Terms and Conditions by checking the corresponding box.
  6. Order Confirmation : Once payment has been made in full, a confirmation email will be sent to the Customer at the email address provided when placing the Order.
  7. The Order is then recorded and processed by Maison Aïla, at which time it checks the availability of the Product(s) ordered.
  8. Confirmation of sending the Order : The Customer receives an e-mail confirming the sending. The sale is only deemed final on the date this e-mail is sent.

Any Order placed, validated by the Customer and confirmed by the Seller, under the conditions and according to the terms described above, on the website: https://maisonaïla.com/ constitutes the formation of a contract concluded remotely between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any Order from a Customer with whom there is a dispute relating to the payment of a previous order.

Order tracking : The Customer will be able to track the progress of his Order on the website: https://maisonaïla.com/ in his customer area. The Customer will also receive information by email on the tracking and processing of his Order. If the Customer wishes to obtain information concerning the tracking of his order, he can directly contact the chosen carrier and track the delivery of his package.

  1. Personal data

In application of Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018, it is recalled that the personal data requested from the Customer are necessary for the processing of his Order and the establishment of invoices in particular. This data may be communicated to the Seller's potential partners responsible for the execution, processing, management and payment of Orders. The processing of information communicated via the website: https://maisonaïla.com/ meets the legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.

At any time, the Customer has a permanent right of access, modification, rectification, opposition, portability and limitation of processing with regard to information concerning him. To exercise this right, he can make a request to the customer service by e-mail: maisonaila.world@gmail.com

Subject to the Client's agreement ("opt-in"), personal information concerning him/her may be used by Maison Aïla and/or its partners for commercial purposes such as sending newsletters or other solicitations.

The Site uses Cookies in order to best meet the Client's needs and personalize them.

  1. Payment Terms

We offer different payment methods in different countries. In all countries we accept credit cards, but in many countries we also offer Paypal and country-specific payment methods. When you checkout, you will see which payment methods we offer in your delivery country.

The Customer expressly acknowledges that the communication of his bank card number to the Seller constitutes authorization to debit his account up to the price of the Products ordered. Failing this, a notification of cancellation of the Order for non-payment will be sent to the Customer at the email address previously provided by the latter.

The price owed by the Customer is the amount indicated on the order summary page.

The amount debited corresponds to the Products actually delivered and the related costs.

The debit will be made at the time of the Order.

If a Product were to be sold out between the debit and the actual delivery, a refund for the sold out Product would be generated as soon as possible.

  1. Deliveries

The amount of preparation and shipping costs depends on the country and the total amount of the Order. They are detailed on the invoice.

Maison Aïla cannot be held responsible for any action and/or costs and/or taxes (which are the responsibility of the Customer) and/or delays due to customs services over which it has no control.

For all Products, the Order is prepared for departure from the Maison Aïla warehouse within a maximum of 3 working days from the day following the validation of the Order. Orders registered on the website https://maisonaïla.com / on Friday, Saturday or Sunday will be processed on the following Monday. Orders registered on a public holiday other than Friday, Saturday and Sunday will also be processed on the following working day.

During private sales, sales or archive sales: this shipping time may be extended by a maximum of 15 working days. It may also be extended to the day after a new collection is put online or during the Christmas shopping period between November 23 and December 31.

If the Products ordered have not been delivered within 30 working days after the indicative delivery date, for any reason other than force majeure or the actions of the Customer, the sale may be terminated at the written request of the Customer under the conditions set out in Articles L216-2, L216-3 and L241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him no later than 14 days following the date of termination of the contract, excluding any compensation or deduction.

In any event, the Seller cannot be held responsible for the damaging consequences resulting from a delay in delivery, only reimbursement of the Product by Maison Aïla being possible to the exclusion of any other form of compensation.

In the event of non-conformity of the Product delivered, the Seller undertakes to remedy this or to reimburse the Customer, as indicated in the article “Seller’s Liability – Warranty”.

The Seller bears the risks of transport and is required to reimburse the Customer in the event of damage caused during transport.

Upon receipt of the Order, the Customer is required to check the condition of the packaging and the conformity of the Product delivered and, if necessary, to issue any reservations on the carrier's delivery slip. This verification is considered to have been carried out once the Customer, or a person of their choice, has signed the delivery note. No complaints regarding the condition of the package(s) delivered will be admissible.

In the event of absence, incorrect address or refusal of the package by the recipient resulting in an inability to deliver the Order to the recipient on time, Maison Aïla cannot be held responsible for the final quality of this delivery. In the event of the recipient's absence, according to the carrier's delivery terms and conditions, the Product may be re-presented and/or dropped off at a relay point and/or returned to Maison Aïla.

If Delivery is not possible, no reshipment will be possible and the Customer will be reimbursed within 14 days of receipt of the Order by Maison Aïla.

Deliveries are made using the services of:

  • COLISSIMO (standard delivery) and UPS (express delivery) for mainland France; and
  • Mainly DHL and Chronopost for international deliveries (standard and express).

All international orders are processed through Global-E, our international shipping service provider, and shipped from our warehouse in France.

Customers will be prompted to use our shipping partner, Global-E, at the time of checkout. By doing so, the customer will have the opportunity to prepay their customs duties, import fees and other related charges in advance.

Any claim regarding the delivery of the Products must be made within 14 working days following receipt of the Item(s). The Customer must contact customer service by e-mail: maisonaïla.world@gmail.com

  1. Right of withdrawal

In accordance with the legal provisions in force, the Customer has a period of 14 days from receipt of the Product to notify customer service of the wish to return the Product without having to provide reasons or pay a penalty.

The Customer must complete the online return form or contact customer service by email: maisonaïla.world@gmail.com to inform them of their decision to exercise their right of withdrawal.

Returns are possible within 14 days of the delivery date. Items must be returned in their original condition, with the original labels attached and all packaging. No worn, used or damaged merchandise will be accepted. If the conditions are not met, Maison Aïla reserves the right to refuse the return and refund. Consequently, the Product will be reshipped to you.

The costs and risks associated with returning the Products are the responsibility of the sender. The Seller will not be liable in the event of loss, theft or damage to the package.

All packages must be sent using a traceable method and the tracking number must be communicated to Maison Aïla. The burden of proof of return rests with the Customer.

It is expressly provided that the following items are not taken back: socks.

Sale items are non-refundable and can only be exchanged for a different size or store credit.

The refund will be made within 14 days of receipt of the returned product. The Seller will make the refund using the same means of payment as that used by the Customer for the initial transaction, unless the Parties agree on a different means. This refund will only be made on condition that the Seller has been able to recover the Products subject to the return and the refund request.

In case of payment of the purchase by credit card or in case of expiry of the validity of the card, refunds can only be made by bank transfer. Communication of the RIB is essential to proceed with the refund.

The reimbursement of an Order paid by gift card, e-gift card or credit will be automatically reimbursed as credit.

  1. Seller Responsibilities - Warranties

The Products sold on the website https://maisonaïla.com / comply with the regulations in force in France.

The Products supplied by the Seller benefit automatically and without additional payment, independently of the right of withdrawal, in accordance with the legal provisions:

  • the legal guarantee of conformity for Products which are apparently defective, damaged or damaged or do not correspond to the order; and
  • the legal guarantee against hidden defects arising from a material, design or manufacturing defect affecting the Products delivered and making them unfit for use, according to the terms and conditions set out below.

In order to assert his rights, the Customer must inform the Seller in writing of the non-conformity of the Products within a maximum period of 14 days from the delivery of the Products or of the discovery of hidden defects within the time limits referred to above and return the defective Products in the condition in which they were received with all the elements (accessories, packaging, instructions, etc.)

The Seller will refund, replace or repair any Products or parts under warranty deemed non-compliant or defective.

If the product is replaced, the Seller will cover the return costs.

Shipping costs will be refunded based on the rate charged and return costs will be refunded upon presentation of supporting documents.

The Seller shall not be held liable in the following cases:

  • non-compliance with the legislation of the country in which the Products are delivered, which it is the Customer's responsibility to check;
  • in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer as in the event of normal wear and tear of the Product, accident or force majeure.

The Seller's warranty is, in any event, limited to the replacement or reimbursement of Products which are non-compliant or affected by a defect.

The Seller's liability with respect to any Product purchased on the Site is strictly limited to the purchase price of the latter.

The documents, descriptions and information relating to the Products appearing on the Site are not covered by any guarantee, express or implied, except for the guarantees provided by law.

The Customer acknowledges that it is his responsibility to install appropriate anti-virus and security software on his computer hardware and any other devices in order to protect them from any bugs, viruses or other programming routines of this nature that prove harmful. The Customer assumes all risks related to any content downloaded or otherwise obtained through the use of the Site and agrees that he is solely responsible for any damage.

  1. Rates

The prices of the Products are indicated according to the currency of the customer's delivery country.

All deliveries to Europe are exempt from import duties and taxes. All orders shipped to the United States, Canada and New Zealand are subject to import duties and taxes.

For deliveries to the rest of the world where customs duties are applicable, you can choose to pay the customs duties at checkout or upon receipt of the Order.

The Seller reserves the right to change prices at any time.

These prices do not include processing, shipping, transport and delivery costs, which are charged in addition, under the conditions indicated on the website https://maisonaïla.com / and calculated prior to placing the Order.

If the Customer requests a faster or more expensive shipping method than standard shipping, the additional delivery costs, as they appear at the time of validation of the Order by the Customer, are entirely at the Customer's expense.

All Orders are payable in the currency of the customer's shipping country and must be paid in full upon placing the Order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

  1. Intellectual property

The content of the website https://maisonaïla.com / is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

  1. Disputes

These General Conditions are presented in French. They will also be translated into English, but in the event of disagreement or discrepancy, the French version shall prevail.

All disputes to which the purchase and sale transactions concluded in application of these General Conditions of Sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their follow-ups and which could not have been resolved between the seller and the customer will be submitted to the competent courts under the conditions of common law.

The Customer is informed that he may in any event resort to conventional mediation, in particular with the Consumer Mediation Commission (Consumer Code, article L612-1) or with existing sectoral mediation bodies or to any alternative dispute resolution method (e.g. conciliation) in the event of a dispute.

13. Force majeure

The Parties shall not be held liable if the non-performance or delay in the performance of any of their obligations as described herein results from a case of force majeure, within the meaning of Article 1218 of the Civil Code.
